When it comes to the topic of net neutrality, most scholars agree that it is harmful to the progress of the Internet. Where this arrangement usually ends, however, is the question of the scope of the ISP's power to regulate the Internet. While some scholars believe that net neutrality is critical to the growth of the Internet, others argue that Internet service providers have the right to regulate the very service they provide. This document explores the reasons for maintaining net neutrality and the power that ISPs should have, while also stating that net neutrality is essential for users to disseminate information unhindered and without interference. Net neutrality is publicly accessible information and the transfer of that information. Public travel and communications institutions (e.g., taxis, subways, telephone companies) cannot discriminate or limit common access, and this is also the basic notion underlying net neutrality. In 2005, two important actions radically changed the regulatory landscape applied to broadband services, further fueling the debate on net neutrality. In both cases, these actions led to the subjecting of broadband Internet access services to a less rigorous regulatory framework. In June 2005, the Federal Communications Commission's (FCC) 2002 decision that the provision of cable modem service is an interstate information service and is therefore subject to the least stringent regulatory regime was upheld (Gilroy). Revoking net neutrality would prevent information on the web from being tampered with or obstructed. The anti-net neutrality argument is that ISPs should be able to allocate their resources and establish business partnerships as they see fit, and allowing the FCC to regulate how they do business would effectively stifle innovation. If net neutrality is revoked, allow ISPs to allocate more bandwidth to the platforms and publishers that need it most – Google and Netflix of the world – thus ensuring smoother Internet operation. A free and open Internet is the greatest technology of our culture, and control should not be at the mercy of multinational corporations. Diminishing net neutrality would mean the end of an equal opportunity market where startup websites can build their own foundations and users can spread information without interference.
